Please read this Terms of Service Agreement carefully before using Fortexa's services.
Trading in cryptocurrency and Contracts for Difference (CFDs) is leveraged and carries a high level of risk. You may lose some or all of your invested capital, and these products are not suitable for everyone. You should not trade with money you cannot afford to lose. By using the Service you confirm that you have assessed these risks and accept them.
This Terms of Service Agreement (this "Agreement") states the terms and conditions upon which Fortexa (herein "the Company," "Fortexa," "we" or "us") will provide services to you on the Fortexa platform (herein the "Service"). These Terms constitute a contractual agreement between you (the Client) and us. By visiting, accessing, using, joining and/or participating in (herein collectively "using") the Service, you express your understanding and acceptance of these Terms.
As used in this document, the terms "the Client," "you" or "your" refer to you, any entity you represent, your representatives, successors, appointees and affiliates, and any of your or their devices. If you do not agree to be bound by these Terms, cease using the Service immediately and inform us of your disagreement. Fortexa provides an online platform that allows you to enter into leveraged transactions defined as CFDs (Contracts for Difference) on underlying instruments such as cryptocurrencies, currency pairs (forex), and precious metals such as gold (XAU). When you trade a CFD you do not own or take delivery of the underlying asset.
Fortexa is a brand operated by Muskarat Ltd, a company registered in St. Vincent and the Grenadines under registration number 110661. Muskarat Ltd is the entity with which you enter into this Agreement.
The St. Vincent and the Grenadines Financial Services Authority does not license or regulate forex or CFD brokerage activity; it registers companies. Accordingly, Muskarat Ltd is incorporated and registered in St. Vincent and the Grenadines but is not licensed as a forex/CFD broker in that jurisdiction. The Service is provided on an execution-only basis to clients in permitted jurisdictions, and is not covered by any investor compensation scheme.
You must be over eighteen (18) years of age to use the Service, unless the age of consent in your jurisdiction is higher, in which case you must be at least that age. You acknowledge and guarantee that you meet this requirement. We reserve the right to request proof of age, and your account may be suspended until satisfactory proof is received.
The Service is offered only in jurisdictions where it is lawful to do so and only to Clients located in permitted territories. The Service is intended primarily for Clients resident in the Commonwealth of Independent States (CIS) and certain other permitted markets, as determined by the Company from time to time. Use of the Service is not permitted where prohibited, and you acknowledge that you are not otherwise prohibited from using it.
Without limiting the foregoing, use of the Service is not permitted if you are located in, or are a resident or citizen of, any jurisdiction where the offering of leveraged products is prohibited or restricted, any sanctioned jurisdiction, or any high-risk and non-cooperative jurisdiction as defined by the Financial Action Task Force (FATF) and the Caribbean Financial Action Task Force (CFATF). These lists are subject to periodic update by the relevant agencies.
Use of the Service is not permitted if you are a Politically Exposed Person (PEP). By using the Service you declare that you are not a PEP.
You acknowledge that your ability to access the Service does not necessarily mean that you are eligible to use it.
We grant you a non-exclusive, non-transferable, limited right to access, non-publicly display, and use the Service, including all content and services available therein (the "Content"), consistent with this Agreement (the "Grant"). The Grant is terminable (including partial termination or limitation) by us at will, for any reason and at our sole discretion, with or without prior notice.
Upon termination we may, but shall not be obligated to: (i) delete or deactivate your Account; (ii) block your email and/or IP addresses or otherwise terminate your use of the Service; and/or (iii) take any other action to prevent your use of the Service. You may also terminate your participation at any time by notice to us. You acknowledge that we are not responsible to you or any third party for losses incurred as a result of termination of the Grant.
The Client may terminate the Service at any time by sending the Company a notice of intention to terminate. Upon termination, the provisions of the "Deposits and Withdrawals" and "Promotions and Bonuses" sections (including those regulating withdrawals for a Client that has used the bonus program) continue to apply.
You must create an account on the Service (an "Account") to use the Service. You represent and warrant that all information you provide is complete and accurate, and you shall update it when it changes or at the Company's request. You acquire the right to use the Service upon confirmation of your email address. By creating an Account on behalf of a company or entity, you represent that you have the authority to bind that entity.
You shall not use another person's or entity's Account without authorization. You are solely responsible for maintaining the confidentiality of your Account and for all activity that occurs under it, and you shall notify us immediately of any breach of security or unauthorized use. The Company shall not be liable for losses resulting from unauthorized use of your Account, and you indemnify and hold us harmless for any such use.
You may only have one Account and may not share it. If the Company has reasonable grounds to believe an Account was opened with intent to defraud, or that multiple accounts were created without approval, the Company reserves the right to cancel any transaction related to that Account.
You authorize the Company, directly or through third parties, to make any inquiries we consider necessary to validate your identity (KYC), including requesting further information, confirming ownership of your email address or wallets, and verifying your information against third-party databases. We may request your identification documents at any time.
The Service allows you to engage in leveraged CFD transactions on cryptocurrencies, currency pairs, and precious metals such as gold (collectively, "Transactions"). You acknowledge that you engage in every Transaction as a principal, and that we do not act as your agent. You are directly and fully responsible for fulfilling all obligations regarding your Transactions.
The Service carries out your Transactions on an execution-only basis. We are entitled to execute your Transactions even where a Transaction is not beneficial to you. We do not manage your Transactions, nor advise you on them, and we are under no obligation to monitor them, issue margin alerts, or close out any of your open positions.
CFD trading is leveraged. You must maintain the required margin on your Account at all times. Where your margin level falls below the applicable threshold, we may close some or all of your open positions automatically, in whole or in part, without prior notice (stop-out / margin close-out), in order to limit further losses. Applicable leverage, margin requirements, minimum and maximum position sizes, spreads, swap/financing charges, and other trading parameters are those set out on the Platform and/or our Trading Conditions page, and may be varied or capped by us at our sole discretion, including for risk-management or regulatory reasons.
Prices quoted on the Platform are derived from one or more liquidity or data sources and may differ from prices on other venues. In volatile or illiquid conditions, your order may be executed at a price different from the requested price (slippage). Our pricing may include a spread in our favor, which means the values involved may differ from prices on primary markets. We do not support physical delivery of any underlying asset; any gains or losses are credited to or debited from your Account after the Transaction is completed.
You acknowledge and agree that where any Transaction is completed at prices that do not reflect actual market prices for any reason (including an undetected programming error, glitch, feed delay, or other mispricing), we reserve the right to cancel or roll back such Transactions.
Each Transaction carries a round-turn fee, calculated when the position is opened and deducted once when it is closed. It covers both the opening and the closing; no separate closing fee is charged. The fee rate per instrument is shown on the Platform and in the API.
A position that remains open at the daily rollover (00:00 UTC) is additionally subject to an overnight financing charge (a "swap"). The charge is a percentage of the position notional per night and differs for long and short positions; current rates are published on the Platform and in the API. Cryptocurrency positions are charged every night, including weekends. Positions in instruments that do not trade at weekends (currency pairs, metals, oil) are not charged on Saturday and Sunday and are charged at a triple rate on the designated weekday, which covers the weekend carry. The charge accrues against the position, is deducted once when the position is closed, and reduces the margin supporting that position, which brings its liquidation price closer. Accrued financing charges never exceed the margin of the position. We may vary the rates at our discretion; the rates shown on the Platform at the time of the rollover apply.
The Platform offers a copy trading feature that allows you (a "Follower") to automatically mirror the Transactions of another user (a "Trader"). If you subscribe to a Trader, Transactions are opened and closed on your Account automatically, without further instruction from you, for as long as the subscription is active.
You acknowledge and agree that: (a) a Trader is another customer of the Platform, not our employee, agent, adviser or representative, and we neither select, endorse, supervise nor verify their strategy; (b) copy trading does not constitute investment advice, portfolio management or a personal recommendation, and remains execution-only; (c) past results of any Trader, however presented on the Platform, are not a reliable indicator of future results; (d) copied Transactions are sized in proportion to the amount you allocate to the subscription, and are subject to the same fees, financing charges, margin requirements and liquidation rules as Transactions you place yourself; (e) a Transaction may be copied late, at a different price, partially, or not at all — in particular where your allocated amount or free margin is insufficient, where the market has moved, or where the instrument is unavailable to you; and (f) when the Trader closes a position, or it is closed by a stop-out, the corresponding position on your Account is closed too.
A Trader may charge a commission on the profit you realise from copied Transactions. The applicable rate is shown before you subscribe. The commission is calculated on your net result after our fees and financing charges, is charged only where that result is positive, and is not charged on demo accounts. We may deduct it from your Account and pass it to the Trader.
You may stop a subscription at any time on the Platform; stopping it prevents new Transactions from being copied and does not by itself close positions already opened, which remain yours to manage. We may suspend, limit or terminate the copy trading feature, any subscription, or any user's eligibility to be copied, at any time and without prior notice, including where we suspect abuse, manipulation, or conduct that harms other customers. All Transactions executed on your Account through copy trading are your Transactions, and you bear sole responsibility for the resulting profits and losses.
We may provide programmatic access to the Service through our public API. API keys are issued in your Account, are bound to a specific account (demo or live) and to the permissions selected when the key is created, and are subject to published rate limits. The secret part of a key is shown once and is not recoverable; you are responsible for storing it securely and for every Transaction placed with your keys, including Transactions placed by software you did not write or by a third party who obtained your key. Withdrawals cannot be made through the API.
The API is provided as is. We may change, deprecate, rate-limit, suspend or revoke API access, in whole or in part and for any individual key or Account, at any time — including for risk management, security, load, or suspected abuse — and we are not liable for losses arising from such changes, from downtime, from latency, or from any failure of your software to handle errors, rejections or duplicate submissions correctly. You are responsible for testing your software, for handling every documented error code, and for any losses caused by its behaviour.
YOU UNDERSTAND AND ACKNOWLEDGE THAT YOU MAY LOSE MONEY AS A RESULT OF YOUR USE OF THE SERVICE (INCLUDING AS A RESULT OF YOUR EXECUTION OF TRANSACTIONS) AND THAT YOU TAKE SOLE RESPONSIBILITY FOR SUCH LOSSES.
You, your Transactions, and your use of the Service must satisfy all of the following restrictions ("User Restrictions"):
We may use manual and automated methods to ensure compliance and retain the sole right to determine whether you have complied. Where we become aware of a possible violation, we may investigate, and you agree to comply with all reasonable requests during such investigation.
We reserve the right to take appropriate action for any breach, including civil, criminal, and injunctive remedies in addition to termination of the Grant, and to cancel, roll back, and/or close any Transactions we determine, in our sole discretion, to be made in violation of this Agreement.
When using the Service you may be exposed to information, data, and content from various sources (collectively, "Content"), including market information such as quotes, news, analyst opinions, research, and graphs, some of which is drawn from third parties ("Third Party Content"). The Company does not control and is not responsible for Third Party Content. All Content is provided for information purposes and "AS-IS," and we make no representations as to its accuracy, timeliness, completeness, or authenticity.
Market Information is not investment advice; we make it available only for your information and convenience. You acknowledge that Content may not correspond exactly with real-world values and may become unreliable, and we undertake no obligation to update it and may discontinue it at any time without notice. All Content is subject to copyright, trademark, and other proprietary rights, and you may not exploit it except as explicitly permitted.
To engage in Transactions you must fund your Account (a "Deposit"). Funding is made exclusively in cryptocurrency, using the supported assets and blockchain networks made available on the Service from time to time at our sole discretion (for example, stablecoins and other supported coins on supported networks). We reserve the right to add or remove supported assets and networks at any time.
You are solely responsible for sending funds to the correct deposit address on the correct network, as displayed on the Service for each Deposit. Transfers sent to an incorrect address, on an unsupported network, or in an unsupported asset may be delayed, unrecoverable, or permanently lost, and the Company shall not be liable for any such loss. Deposits are credited after the required number of network confirmations.
Funds credited to your Account may not be segregated from other funds, including our own or those of other users. We will not pay interest on deposited funds, and we may use your funds in any manner until they are withdrawn in accordance with this Agreement.
Withdrawals are carried out on the basis of a withdrawal request submitted by you and are paid in cryptocurrency to a wallet you control. To prevent fraud and money laundering, we may require withdrawals to be made to the same wallet or verified source used to fund the Account, and we may decline, delay, or place a hold on a withdrawal where we have a reasonable suspicion of fraud, error, or a breach of this Agreement. Minimum withdrawal amounts, limits, and any applicable fees (including network/blockchain fees) are those set out on the Platform. The minimum withdrawal amount is $50 (or the equivalent in the supported crypto asset). Approved withdrawals are processed within up to 24 hours of approval; blockchain network confirmation times may add further delay.
We may request additional documentation supporting your authentication prior to executing a withdrawal, in accordance with our AML policies, and such documentation is a prerequisite for execution. We may implement any additional security and AML rules we deem necessary to prevent or limit money laundering, fraud, or other unlawful activity. The Company remains liable for repayment of funds in accordance with your withdrawal request even where the relationship is terminated.
You agree to pay all applicable trading fees, spreads, swap/financing charges, and network fees according to the Company's fee structure as set out on the Platform, which we may change at our sole discretion with immediate effect. You are solely responsible for all taxes due under the law of your country of residence arising from your use of the Service, and for providing accurate wallet and payment details; you acknowledge that you are solely responsible for mispayments arising from incorrect or obsolete information.
Where funds accrue to your Account in breach of this Agreement, we may set off the amount (plus related fees) against remaining funds, or invoice you, payable within two (2) business days. Where you owe us an amount exceeding the funds in your Account (including as a result of losses from Transactions), we may invoice you, payable within two (2) business days. Where we form a reasonable belief that you have used the Service in breach of this Agreement, we may terminate the Grant and withhold all funds in your Account, including deposits, profits, and bonuses.
The Company may, from time to time, offer promotions and bonuses to new and existing Clients. Participation is a privilege, not a right, and the Company may grant, vary, refuse, or withdraw it at any time at its sole discretion. The specific conditions of each promotion or bonus — including any trading-volume or turnover requirements that must be met before bonus funds or related profits may be withdrawn — are those published on the Service or otherwise communicated to the Client at the time of the offer.
Bonuses are credited only after the Client has completed identity verification. Where we detect abuse, fraud, manipulation, or any attempt to obtain a bonus or meet its conditions in bad faith, we reserve the right to adjust the relevant account, cancel the bonus and any related profits, and recover the corresponding amounts, without prior notice. The Company may change or cancel any promotion or bonus program at any time.
We maintain a separate Privacy Policy, incorporated herein by reference; your acceptance of this Agreement also signifies your acceptance of the Privacy Policy. We may amend the Privacy Policy at any time by posting amendments to the Service, and your continued use of the Service constitutes acceptance of those amendments.
You agree to receive information from the Company in the form of emails, push notifications, and SMS to the contact details you provided. You can unsubscribe at any time by contacting support.fortexatrade@gmail.com.
To ensure service quality, your communications with our staff may be recorded without prior notice. You agree that such recordings and their transcriptions may be used as evidence in the event of a dispute.
You acknowledge that your use of the Service, including the execution of any Transactions, is at your own risk. You accept the high level of risk inherent in leveraged CFD trading and as set out in the Risk Statement available on the Service, which is incorporated herein by reference.
You understand that cryptocurrency and CFD trading carries the risk of loss, including the loss of your entire invested capital. We ask you to responsibly assess whether these risks are acceptable to you. By accepting this Agreement, you confirm that you have studied these risks, assessed the possible consequences of your actions, and fully accept them.
Under no circumstances will we be liable for direct, indirect, incidental, special, consequential, or exemplary damages resulting from any aspect of your use of the Service, whether arising from:
The Company is not responsible for the results of your use of third-party services, products, or information presented or advertised in connection with the Service. Where you are involved in a dispute with third parties, you release us and our officers, employees, agents, and successors from all claims, demands, and damages arising out of or related to such disputes and/or the Service.
You expressly agree that your use of the Service is at your sole and exclusive risk. The Service is provided "AS-IS" and without any warranty or condition, express, implied, or statutory. Some jurisdictions do not allow certain limitations of liability; in such cases the Company operates in accordance with the laws and regulatory requirements of those jurisdictions.
At Fortexa we take Clients' complaints seriously. If you have a complaint regarding the services provided to you, you should inform us immediately. Set out below is the procedure for handling complaints and disputes.
Complaints should be communicated in writing to your account manager, with a copy sent to support.fortexatrade@gmail.com.
When a written complaint is received, the account manager has 7 days to attempt to resolve it directly with the Client. If it cannot be resolved within 7 days, it is escalated to the Compliance Officer, who within 7 days of being notified will ensure an acknowledgement letter is sent to the Client identifying the person handling the complaint.
The Compliance Officer acts as an impartial investigator and will attempt to resolve the complaint within 7 days of the acknowledgement letter; if more time is needed, an additional 7 days may apply. If the complaint is more complex and takes longer than 28 days, we will communicate the reasons for the delay. Each complaint is handled case-by-case at no charge to the complainant, subject to statutory requirements, and the Compliance Officer maintains a register of all complaints reviewed at least monthly and as part of the annual compliance audit.
This Agreement shall be governed by the law of St. Vincent and the Grenadines, and the parties hereby consent to the exclusive jurisdiction of the courts of St. Vincent and the Grenadines.
This Agreement, and the fact that you use the Service, do not suggest the presence of a partnership, joint venture, agency, franchise, sales-representative, or employment relationship, and nothing in it is intended to confer rights or remedies upon any third party.
We reserve the right to amend this Agreement (including any documents referenced or incorporated herein) at any time by posting the amendments on the Company's website. All amended terms shall be effective 10 days after their initial posting, or as of the first time you use the Service after the amendments, whichever is sooner. Your continued use of the Service following such amendments constitutes acceptance, regardless of whether you have read them. If you do not agree to the changes, do not use the Service and inform us in writing immediately.
This Agreement constitutes the entire agreement between you and us and supersedes all prior agreements. Our failure to enforce any provision will not be construed as a waiver. If any part is determined to be invalid or unenforceable, it will be superseded by a valid, enforceable provision that most closely matches the original intent, and the remainder shall continue in effect. This Agreement is not assignable by you except with our prior written consent, but may be assigned or transferred by us without restriction and without notice.
Force Majeure. We shall not be responsible for reasonable delay or failure in performance caused by acts of God, natural disasters, terrorism, strikes, embargoes, fires, war, blockchain network failures, or other causes beyond our reasonable control ("Force Majeure"). In such cases we may, at our discretion, terminate or suspend the Service and/or cancel, close, and/or reverse any open Transactions.
Section titles are for convenience only and have no legal value; the term "including" is illustrative and not limiting. Where this Agreement is available in a language other than English, the English version takes precedence in case of conflict. This Agreement includes the following applications: the Risk Statement, the Privacy Policy, and the trading conditions published on the Company's website. The Agreement is effective as of the date of the Client's acceptance, which is concluded when the Client registers on the Company's website and opens a trading account.
